How a matter usually runs from abroad

  1. Video call

    On WhatsApp video, Google Meet or Zoom, at a time that suits your time zone. You share photos or scans of the jamabandi, sale deed, will or any notice received.

  2. Records check in Jaipur

    The revenue and registration records are verified locally, and you receive a written note on the legal position and options by email.

  3. Power of attorney

    The POA is drafted and sent to you. You sign it in the country where you live and get it apostilled or attested (see below), then courier the original to India.

  4. Stamping in India

    The original POA is stamped in Rajasthan within three months of its arrival in India, as the stamp law requires.

  5. Work on the ground

    Filing, court appearances, registration and mutation are done here under the POA, or by video conference where the court allows it.

Rajasthan land terms, explained

Jamabandi
The revenue record showing who holds a piece of land, updated by the tehsil.
Khasra
The survey number that identifies a specific plot on the village map.
Namantaran
Mutation: changing the name in the revenue record after sale, gift or death.
Khatedar
The person recorded with tenancy rights over agricultural land.
Patta
A title or lease document for a residential plot, usually issued by a municipal body or panchayat.
Registry
The common name for a registered sale deed at the Sub-Registrar office.

Matters in this area: removal of unauthorised occupants, partition among family members, mutation after a death in the family, sale or gift of property through POA, and title verification before buying. Note that NRIs and OCI cardholders can inherit agricultural land but generally cannot buy it under Indian foreign exchange rules.

General legal information

My bank has sent a notice under section 13(2). What can I do?

You have 60 days to pay or to send a written objection. The bank must consider your objection and reply within 15 days. If the bank later takes possession, you can challenge it before the DRT within 45 days.

How long does mutation take after a death in the family?

It depends on whether all legal heirs agree. An undisputed mutation can move quickly once the death certificate and heirship papers are filed; a disputed one goes through a hearing before the revenue officer.

Can I handle my property case from abroad?

Yes. Most steps can be done through a properly executed and stamped power of attorney, with consultations by video. Your personal presence may be needed only for certain steps, such as giving evidence, which can sometimes be done by video conference.

How long does trademark registration take?

An application without objections or opposition often completes within 12 to 18 months. Your mark gets the benefit of the filing date from the start, and you can use the ™ symbol while it is pending.

Which documents are usually relevant in a property matter?

Any notice, order or summons you have received, property papers such as the sale deed, jamabandi or registry, identity proof, and a short written timeline of events.
